By accessing https://magic-testimonials.com/, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by FTR Services d.o.o..
We, FTR Services d.o.o., reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Description of Service
Magic Testimonials is a cloud-based platform operated by FTR Services d.o.o. that enables businesses to collect, manage, and display customer testimonials. The service includes, but is not limited to: automated testimonial request emails and SMS, video testimonial recording, testimonial review and management dashboards (ReviewHQ), embeddable widgets and Walls of Love, FOMO popups, custom domain support, and visitor analytics.
The specific features available to you depend on your subscription plan. Feature availability and plan limits are described on our pricing page and may change from time to time.
Accounts and Registration
To use the service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You may not share your account credentials with third parties or allow multiple individuals to use a single account, unless your plan explicitly permits multiple users. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared in violation of these terms.
Subscriptions, Billing, and Payment
Magic Testimonials offers subscription plans on monthly and yearly billing cycles. All plans include a 7-day free trial. At the end of your free trial, your chosen plan will automatically begin and your payment method will be charged unless you cancel before the trial ends.
Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) at the then-current rate unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to the service until then.
All payments are processed by a third-party payment provider. By subscribing, you also agree to that provider’s terms of service. Prices are listed in USD and may be subject to applicable taxes based on your location.
We reserve the right to change subscription pricing with at least 30 days’ notice. Price changes will take effect at the start of your next billing cycle following the notice period.
User Content and Data
You retain ownership of all content you upload, create, or collect through the service, including testimonials, videos, customer lists, and other data (“User Content”). By using the service, you grant FTR Services d.o.o. a limited, non-exclusive, worldwide license to host, store, process, and display your User Content solely for the purpose of providing and improving the service.
You are solely responsible for ensuring that your User Content does not violate any applicable laws or third-party rights. You represent and warrant that you have obtained all necessary consents from individuals whose testimonials or personal data you collect through the platform.
Upon termination of your account, we will retain your User Content for 30 days, after which it will be permanently deleted. You may export your data at any time while your account is active.
Limitations of Use
By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:
- modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
- remove any copyright or other proprietary notations from any materials and software on this website;
- transfer the materials to another person or “mirror” the materials on any other server;
- knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service FTR Services d.o.o. provides;
- use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
- use this website or its associated services in violation of any applicable laws or regulations;
- use this website in conjunction with sending unauthorized advertising or spam;
- harvest, collect, or gather user data without the user’s consent; or
- use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.
Acceptable Use Policy
In addition to the general limitations of use already stated and also those available on https://magic-testimonials.com/acceptable-use-policy/, you agree not to:
- Send testimonial requests to individuals who have not consented to receive communications from you
- Use the platform to send spam or unsolicited commercial messages in violation of CAN-SPAM, GDPR, or other applicable anti-spam legislation
- Upload or publish fabricated, misleading, or fraudulent testimonials
- Use automated scripts, bots, or scrapers to access the service beyond the intended API or interface
- Exceed the usage limits of your plan through technical circumvention
- Use the service in any way that could damage, disable, or impair our servers or interfere with other users’ use of the service

Service Availability
We strive to maintain high availability of the service but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance when possible.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. If we discontinue a material feature of your plan, we will provide at least 30 days’ notice and, where appropriate, offer a prorated refund or credit for the affected period.
Indemnification
You agree to indemnify, defend, and hold harmless FTR Services d.o.o., its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your User Content; (c) your violation of these Terms of Service; or (d) your violation of any rights of a third party.
Intellectual Property
The intellectual property in the materials contained in this website are owned by or licensed to FTR Services d.o.o. and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.
This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by FTR Services d.o.o. at any time.
Liability
Our website and the materials on our website are provided on an ‘as is’ basis. To the extent permitted by law, FTR Services d.o.o. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall FTR Services d.o.o. or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if FTR Services d.o.o. or an authorized representative has been notified, orally or in writing, of the possibility of such damage.
In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
To the maximum extent permitted by law, the total aggregate liability of FTR Services d.o.o. for any claims arising out of or related to the service or these Terms of Service shall not exceed the total amount you have paid to FTR Services d.o.o. in the twelve (12) months immediately preceding the event giving rise to the claim.
Accuracy of Materials
The materials appearing on our website are not comprehensive and are for general information purposes only. FTR Services d.o.o. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Refund Policy
Free Trial
All subscription plans include a 7-day free trial. During the trial period, you will not be charged. You may cancel your subscription at any time during the trial period without incurring any charges. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.
Monthly Subscriptions
Due to the digital nature of our service, all monthly subscription payments are non-refundable once processed. If you cancel your monthly subscription, you will retain access to the service until the end of your current billing period. No partial or prorated refunds will be issued for unused time within a billing cycle.
Yearly Subscriptions
If you purchase a yearly subscription and are dissatisfied with the service, you may request a refund within 14 days of your initial yearly payment (not applicable to renewals). Refund requests made within this 14-day window will be processed for the full yearly amount, minus any usage-based costs incurred. After the 14-day window, yearly subscriptions are non-refundable. If you cancel, you will retain access until the end of your annual billing period.
How to Request a Refund
To request a refund, please contact us at support@magic-testimonials.com with your account email and the reason for your request. We will respond within 5 business days.
EU Consumer Rights
If you are a consumer located in the European Union, you have the right to withdraw from a digital content purchase within 14 days of purchase under the EU Consumer Rights Directive, provided that you have not started using the service. By actively using the service during the withdrawal period, you acknowledge and agree that you forfeit your right of withdrawal.
Chargebacks
If you initiate a chargeback or payment dispute with your payment provider instead of contacting us directly, we reserve the right to suspend your account immediately pending resolution. We encourage you to contact us first so we can resolve any billing issues promptly.
Exceptions
We reserve the right to issue refunds at our sole discretion in exceptional circumstances, such as extended service outages or billing errors caused by us. Any such refunds will be processed through the original payment method via our payment processor.
Right to Terminate
We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
Severance
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Croatia. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
Force Majeure
FTR Services d.o.o. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, internet or telecommunications failures, power outages, cyberattacks, pandemics, or failures of third-party service providers.
Privacy and Data Protection
Your use of the service is also governed by our Privacy Policy, available at https://magic-testimonials.com/privacy-policy. By agreeing to these Terms of Service, you also acknowledge that you have read and agree to the Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy regarding the handling of personal data, the Privacy Policy shall prevail.
